Terms and Conditions

Last updated: 26 October 2026

1. Introduction

Welcome to BrendanElliott.net (“the Website”).

These Terms and Conditions (“Terms”) govern your use of the Website and the mentoring and coaching services provided by Brendan Elliott (“I”, “me” or “my”).

By using the Website, you agree to these Terms. If you do not agree, please discontinue use of the Website.

If you engage my mentoring and coaching services, the specific terms agreed with you before the service begins will also apply. Where a separate written client agreement covers a particular aspect of the service, that agreement will take precedence over these general Terms to the extent of any inconsistency.

Nothing in these Terms excludes or limits any rights you have under applicable law, including the Australian Consumer Law.

2. About my services

I offer one-to-one mentoring and coaching for men who want to grow in faith, family life, work, leadership and personal formation.

My primary offer is A Season of Walking Alongside, which consists of:

  • Six individual conversations over approximately 90 days.

  • Conversations of approximately 60 minutes each, generally scheduled fortnightly.

  • Meetings by phone or video.

  • A final conversation to review the season and consider whether to continue, change direction or rest.

Before committing to a season, you can arrange an initial conversation of approximately 30 minutes to discuss your circumstances, what you are looking for and whether working together is appropriate.

The initial conversation does not oblige either of us to proceed.

The scope, timing, fee and any additional arrangements for your season will be confirmed with you before the service begins.

3. Nature and limits of the service

My role is to walk alongside you as a companion and coach, offering attentive listening, honest questions, reflection and support as you consider your next steps.

My mentoring and coaching service is not psychotherapy, psychological treatment, medical care or counselling provided by a registered health practitioner. It is not a substitute for professional medical, psychological, legal, financial or other specialist advice.

I do not diagnose or treat mental health conditions as part of this service.

If your needs fall outside my role, experience or competence, I may recommend that you seek support from an appropriately qualified professional.

My service is not an emergency or crisis service. If you or someone else is in immediate danger, contact emergency services. In Australia, call 000.

4. Eligibility

My one-to-one mentoring and coaching service is intended for adults aged 18 and over.

By engaging my services, you confirm that you are at least 18 years of age and that the information you provide is accurate to the best of your knowledge.

I reserve the right to decline or discontinue an engagement where the service is not suitable for your needs, subject to any applicable legal obligations.

5. Booking and the client relationship

The initial conversation is an opportunity for both of us to consider whether working together is appropriate.

A paid season begins when we have agreed on the scope, fee and relevant arrangements and you have accepted the offer to proceed.

Before the season begins, I will provide or confirm the relevant practical terms, including the agreed fee, payment arrangements, scheduling, cancellation and rescheduling arrangements.

You are responsible for participating in the conversations and deciding what actions, if any, you take as a result. I will provide the service with reasonable care and skill, but I cannot make decisions on your behalf or guarantee particular outcomes.

6. Fees and payment

The current advertised fees for A Season of Walking Alongside are:

  • Founding rate: AUD $720 per season for the first three founding participants, while those places remain available.

  • Standard rate: AUD $900 per season.

The applicable fee will be confirmed before you commit. A price offered and accepted for a particular season will not be changed during that season unless both of us agree or the change is otherwise permitted by law.

Payment timing, available payment methods and any agreed instalment arrangements will be communicated before the service begins.

All fees are stated in Australian dollars. Any applicable GST will be identified in the price or payment information provided to you. I will not represent a price as GST-inclusive or GST-exclusive without an appropriate basis.

You are responsible for ensuring that any payment method you use is authorised for your use.

If a payment issue arises, I will contact you to discuss a reasonable way to resolve it before taking further action, subject to any applicable agreement and law.

7. Scheduling, cancellations and missed sessions

The six conversations are intended to take place over approximately 90 days, generally at fortnightly intervals. We will agree on suitable times together.

If you need to reschedule a conversation, please provide as much notice as reasonably possible, preferably at least 48 hours.

If you cancel at short notice or miss a scheduled conversation, we will consider whether it is practical to reschedule within the season. A missed or late-cancelled conversation may count as one of the six conversations where this was clearly agreed in advance in the client arrangements and is lawful in the circumstances.

I will aim to provide reasonable notice if I need to reschedule a conversation. If I am unable to provide an agreed conversation, I will work with you to arrange a replacement time or another appropriate solution.

If illness, an emergency or other exceptional circumstances affect either of us, we will communicate and consider a reasonable adjustment.

Any specific cancellation fees, expiry arrangements or rules for unused conversations must be clearly communicated and agreed before the season begins. They will not override any rights you have under the Australian Consumer Law.

8. Ending a season and refunds

A season is designed to provide six conversations over approximately 90 days. If your circumstances change and you wish to stop early, please contact me so we can discuss the situation and any remaining arrangements.

Refunds, credits, rescheduling and other remedies will be considered in light of the services already provided, the agreed client arrangements and applicable law.

Nothing in these Terms removes your entitlement to a refund or other remedy where required by the Australian Consumer Law, including where a service fails to meet a consumer guarantee.

I will not apply a blanket “no refunds” rule where the law provides a right to a remedy. Any amount payable or refundable when a season ends early will be assessed fairly and consistently with applicable law and the agreed arrangements.

9. Confidentiality

I aim to provide a respectful space where you can speak honestly about your life, faith, family, work and leadership.

I will handle information shared in our conversations with care and will not disclose the substance of our conversations to others without your consent, except where disclosure is required or otherwise permitted by law.

Confidentiality is not absolute. Circumstances involving serious safety concerns, legal obligations or other circumstances recognised by law may require or permit disclosure.

Before we begin working together, I will explain the confidentiality arrangements and any relevant limits.

I may keep digital notes relating to our conversations to support continuity and appropriate administration of the service. The collection, storage, use and disclosure of personal information are addressed in my Privacy Policy.

10. Your responsibilities

When engaging my services, you agree to:

  • Treat our conversations and communications respectfully.

  • Provide information you believe to be accurate and relevant.

  • Give reasonable notice when you need to change an appointment.

  • Respect appropriate boundaries and the agreed scope of the service.

  • Make your own decisions about your life and any actions you take following our conversations.

I reserve the right to pause or end an engagement where behaviour is abusive, threatening, unlawful or otherwise makes continuing inappropriate. Where reasonable and appropriate, I will explain the concern and discuss next steps with you. Any termination and financial consequences remain subject to applicable law and our agreed arrangements.

11. Intellectual property

Unless otherwise stated, the original text, written materials, branding and other content I create for the Website or provide as part of my services belong to me or are used under appropriate permission or licence.

You may access and use Website content for your personal, non-commercial purposes.

Materials supplied specifically to you during a season are for your personal use. You must not reproduce, distribute, sell, publish or commercially exploit those materials without my prior written permission, except where permitted by law.

This section does not claim ownership over your personal experiences, opinions, ideas or information you share with me.

Third-party names, quotations, photographs and other materials remain subject to their respective owners' rights and applicable licences.

12. Website use

You agree not to use the Website:

  • For unlawful purposes or in breach of applicable law.

  • To attempt unauthorised access to the Website, its systems or other users' information.

  • To transmit malicious code or interfere with the Website's operation.

  • To impersonate another person or knowingly provide false or misleading information.

  • In a way that infringes another person's rights.

I may update, suspend or withdraw parts of the Website where reasonably necessary for maintenance, security, operational or other legitimate reasons.

I will take reasonable steps to keep the Website functioning, but I cannot guarantee uninterrupted access or that it will always be free of errors.

13. No guarantee of particular outcomes

Mentoring and coaching are collaborative processes. The value and outcomes of the work may depend on many factors, including your circumstances, choices and willingness to engage.

I do not guarantee any particular personal, spiritual, relational, professional or leadership outcome.

This does not reduce my obligation to provide services with due care and skill or remove any other rights you have under applicable law.

14. Liability and consumer rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, I am not responsible for losses arising from circumstances outside my reasonable control, your decisions or actions, or your use of the Website in a way that is not intended.

Any limitation of liability in these Terms applies only to the extent that the law permits it. It does not exclude liability where exclusion is unlawful, including any non-excludable consumer rights or guarantees.

15. Privacy

Your use of the Website and my services is also subject to my Privacy Policy, which explains how I collect, use, store and disclose personal information.

Please read the Privacy Policy before submitting personal information or beginning a season.

16. Third-party websites and services

The Website may contain links to third-party websites or services. These links are provided for convenience or information.

I do not control third-party websites and am not responsible for their content, availability, terms or privacy practices. Your use of those services is subject to their own terms and policies.

17. International users

My services are based in Australia and are primarily intended for men located in Australia, although online conversations may be available to people elsewhere by prior agreement.

If you access the Website from outside Australia, you are responsible for complying with any local laws applicable to your use of it.

Personal information may be processed or stored by service providers in Australia or other countries, depending on the services used. Further information is provided in the Privacy Policy.

Nothing in this section removes any mandatory rights or protections that apply to you under relevant law.

18. Changes to these Terms

I may update these Terms to reflect changes to the Website, my services or applicable legal requirements.

The current version will be published on the Website with an updated date. Changes to these general Website Terms do not automatically change the fee or other material terms already agreed for a paid season. Any material change to an existing client arrangement will be handled in accordance with that agreement and applicable law.

You should review these Terms periodically.

19. Governing law and disputes

These Terms are governed by the laws applicable in Queensland, Australia, subject to any mandatory laws that apply in another jurisdiction.

If a concern or dispute arises, please contact me first so we can attempt to resolve it constructively.

Nothing in this section prevents either party from exercising a legal right or seeking relief through an appropriate court, tribunal or other dispute-resolution process.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or severed to the extent necessary. The remaining provisions will continue to apply to the extent that they can operate lawfully.

21. Entire agreement

These Terms govern general use of the Website. They do not replace any separate written client agreement or specific arrangements agreed for a season of mentoring.

The applicable terms for a paid season consist of these Terms, the specific arrangements communicated and accepted for that season, any separate client agreement, and any non-excludable rights under applicable law.
